These Terms and Conditions govern access to and use of the ROCHEFORT 1848 website, products, services, and digital platforms.
By accessing, browsing, purchasing through, or otherwise using our services, you confirm that you have read, understood, and accepted these Terms and Conditions together with our Privacy Policy.
If you do not agree to these Terms, you may not use our services.
1. Company Information

2. Scope of Services
These Terms apply to all website visits, purchases, customer communications, digital services, and related interactions with ROCHEFORT 1848.
We reserve the right to update, modify, suspend, or discontinue any part of our services at any time. We also reserve the right to change website content, features, product representations, and service scope without prior notice, unless mandatory consumer protection law requires otherwise.
3. Eligibility
By using our services or placing an order, you confirm that you:
– are legally capable of entering into binding contracts under applicable law;
– are at least 18 years of age.
We reserve the right to refuse or cancel orders if we have reasonable grounds to believe that a customer lacks legal capacity or is otherwise not entitled to enter into a binding purchase agreement.
4. Products and Availability
All displayed products are subject to availability. During the initial operating phase, certain products may be manufactured on a print-on-demand or made-to-order basis to reduce waste and align production with demand.
We reserve the right to modify collections, discontinue products, change prices, limit quantities, or refuse orders, unless mandatory consumer protection law requires otherwise.
Product descriptions, images, measurements, and other information are provided for general informational purposes and may be updated to reflect operational or commercial changes.
5. Product Representation
We make every effort to accurately represent product colours, textures, materials, measurements, and details. However, visual representations may vary due to screen settings, device displays, lighting conditions, and digital photography. Minor discrepancies between displayed and delivered products do not constitute a defect, provided they do not affect the usability of the product.
6. Order Acceptance
An order placed through our website constitutes a purchase offer by the customer. A legally binding contract is only formed once payment has been accepted and an order confirmation email has been sent by ROCHEFORT 1848.
We reserve the right to refuse or cancel orders, in particular in cases of suspected fraud, pricing errors — including obvious typographical or display errors on the website, which do not give rise to a valid contract — unavailability, or payment issues.
If an order is cancelled after payment has been made, we will refund the full amount promptly.
7. Prices and Currency
All prices are displayed in the indicated currency and are inclusive of any applicable statutory VAT, unless expressly stated otherwise. Prices may be changed at any time before an order is accepted; once an order confirmation has been sent, the price displayed at the time of ordering applies.
Where prices are displayed in multiple currencies, exchange rate differences and conversions applied by payment service providers may affect the final amount charged.
Any customs duties, import taxes, or local charges in the destination country are the responsibility of the customer.
8. Shipping Policy
We offer free standard shipping worldwide, unless otherwise stated.
Estimated delivery times:
– Switzerland: 2–3 business days
– Europe: 3–5 business days
– International: 5–10 business days
These estimates are indicative and do not constitute binding delivery deadlines. During periods of high demand, production delays, or customs processing, handling and delivery times may be longer. We will proactively inform you in such cases.
We are not liable for delays caused by third parties (logistics companies, customs authorities, postal services), unless we have directly caused the delay.
9. Returns and Exchanges
As our products are individually manufactured to order (print-on-demand / made-to-order), no general right of return exists due to a change of mind or incorrect size selection. We strongly recommend consulting the size guide available on our website before placing an order.
Returns are accepted exclusively in the following cases:
– products damaged upon delivery;
– manufacturing defects; or
– damage incurred during transport.
Customers must contact us within 7 days of receiving the goods by email at hey@rochefort1848.com, providing the following: order number, description of the issue, and clear photographs of the defect. Late notifications may result in the forfeiture of any right to remedy.
Mandatory warranty rights under Swiss law remain unaffected.
10. Refund Policy
If a return is approved in accordance with Clause 9, our preferred remedy is a replacement delivery. If a replacement is not possible, ROCHEFORT 1848 may, at its discretion, offer a repair, exchange, or store credit. A monetary refund will only be provided as a last resort in the case of a proven, irremediable defect.
Where the reason for return is attributable to the customer (e.g. ordering the wrong size contrary to the size guide), no monetary refund will be offered; a store credit or exchange may be granted.
Store credits are non-transferable, cannot be redeemed for cash, and are valid for 24 months from the date of issue.
11. Return Shipping Costs
Customers bear the cost of return shipping, unless the return is due to an error on our part (manufacturing defect, transport damage, incorrect delivery). In such cases, we will cover the return shipping costs or provide a prepaid return label.
We recommend using a tracked shipping service. We cannot accept liability for returns sent without tracking that are subsequently lost.
12. Payment Methods
We offer various payment methods, including credit cards, debit cards, PayPal, TWINT, Klarna, and other regional providers. Availability may vary depending on country and currency.
You confirm that you are authorised to use the payment method provided. We may refuse or cancel orders if payments appear unauthorised, fraudulent, or otherwise invalid.
13. Account Creation
Users may create customer accounts to manage orders and track purchases. You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out through your account.

We reserve the right to delete inactive accounts after a period of 3 years of inactivity, following prior notification to the customer by email.
14. Promotions and Store Credits
Promotional offers, gifts, store credits, and campaign benefits may be modified, withdrawn, or made subject to conditions. Unless expressly stated otherwise, such offers may not be combined.
Campaign-specific terms may include minimum order values, product exclusions, time limitations, or geographic restrictions.
Complimentary items, gifts, or benefits included with orders are voluntary gestures, do not create any entitlement for future orders, and cannot be redeemed for cash.
15. Intellectual Property
All content associated with ROCHEFORT 1848 — including logos, designs, collections, graphics, photographs, videos, text, and website layouts — is the exclusive property of the Rochefort 1848 Group or its respective licensors and is protected by copyright.
No materials may be copied, reproduced, distributed, modified, sold, or used for commercial purposes without prior written consent.
16. Prohibited Use
The following uses are prohibited: misuse of the website, fraudulent activity, unauthorised access, disruption of infrastructure, automated content extraction (scraping), identity theft, and the distribution of malicious software.
Violations may result in account suspension, refusal of services, legal action, or reporting to the relevant authorities.
17. Limitation of Liability
To the extent permitted under Swiss law, ROCHEFORT 1848 shall not be liable for indirect damages, consequential losses, loss of profit, or delays caused by third parties. The liability of ROCHEFORT 1848 is in any case limited to the order value of the relevant product; further claims are excluded to the extent permitted by law.
This limitation of liability does not apply in cases of wilful misconduct on the part of ROCHEFORT 1848.
All services are provided to the extent that is technically and operationally feasible.
18. Force Majeure
ROCHEFORT 1848 shall not be liable for delays or failures in performance caused by circumstances beyond our reasonable control, including natural disasters, pandemics, strikes, customs delays, wars, cyber incidents, or governmental measures.
Should such an event occur, we will inform you as quickly as possible and, where feasible, offer an alternative solution.
19. Data Protection
The use of our services is subject to our Privacy Policy, which is available on our website. By using our services, you confirm that personal data may be collected and processed in accordance with that policy and applicable data protection laws (in particular the Swiss FADP and, where applicable, the GDPR).
20. Governing Law and Dispute Resolution
These Terms and Conditions are governed exclusively by Swiss law, to the exclusion of conflict of law rules.
Step 1 — Direct Resolution (mandatory before initiating further steps):
In the event of a dispute, the parties are required to first seek direct resolution. The customer must contact us in writing by email at hey@rochefort1848.com before initiating any mediation or court proceedings, and must allow ROCHEFORT 1848 a period of 30 days to respond. This requirement is a condition for the admissibility of any further steps.
Step 2 — Mediation (optional):
If no direct resolution can be reached, the parties may mutually agree to pursue mediation. Costs and modalities shall be determined by the chosen mediation provider.
Step 3 — Courts of Law:
The exclusive place of jurisdiction is agreed to be Geneva, Switzerland. Swiss law applies exclusively.
21. Amendments to These Terms
We reserve the right to amend these Terms at any time. Updated versions will be published on our website and take effect upon publication.
In the event of material changes, existing customers will be notified by email. Continued use of our services following the entry into force of the amended Terms constitutes acceptance of the updated version.
